AGBS SEILBAHN STAUBERN AG
1. General
The General Terms and Conditions (GTC) apply to all services and products, whether paid or free of charge, provided by Seilbahn Staubern AG. SEILBAHN STAUBERN AG is entitled to use the services of third parties to ensure optimal service provision. This is done with the automatic consent of the customer. For tickets and services provided by third parties, for which SEILBAHN STAUBERN AG acts as a seller or intermediary, the GTC of the respective company and its products apply – such as combined offers with partner companies, etc.
1.1 Contract
The contract with SEILBAHN STAUBERN AG is concluded upon ordering or purchasing a ticket or service or upon using such a ticket or service. These General Terms and Conditions are deemed to be accepted without reservation upon each order/purchase/use.
1.2 ID requirement
Upon request by the cashier/railway/inspection staff, the customer must provide valid official identification (ID, passport, ticket). Barcode cards and KeyCards must also be presented.
1.3 Data carriers
The KeyCard and similar data carriers enable contactless access to the SEILBAHN STAUBERN AG cable cars. It can be programmed with new validity data at any time and can therefore be used for several years. The KeyCard is available at the sales point in the restaurant for a deposit. The deposit will be refunded when the KeyCard is returned. Visibly defective KeyCards will not be replaced free of charge, nor will the deposit be refunded. Barcode and disposable KeyCards are deposit-free day/single-trip tickets and are used for hikers, restaurant visitors, and pedestrians.
1.4 Data protection
The details of SEILBAHN STAUBERN AG's data protection policy are regulated separately. Customer data is used solely to maximize operational safety or in the interests of sales promotion, product design, crime prevention, abuse prosecution, the collection of key economic data and statistics, and invoicing. The customer acknowledges and agrees that, in cases of joint provision of services in cooperation with third parties, SEILBAHN STAUBERN AG is entitled to make customer data available to the third party concerned to the extent necessary in the interests of providing the services. The transfer of customer data is permitted within the framework of the statutory provisions.
1.5 Services
The services provided by SEILBAHN STAUBERN AG are limited to the transport of persons from the valley to the mountain or vice versa.
2. Prices and terms of payment
2.1 Prices
The prices for tickets are published at the valley station of SEILBAHN STAUBERN AG and on the Internet. Unless otherwise stated, the prices for mountain railway tickets are per person and include VAT. In addition to the annual ticket prices, SEILBAHN STAUBERN AG charges a KeyCard deposit of CHF 5.00. It can be used repeatedly, with several offers at the same time and, in some cases, with other companies within the industry. The deposit will be refunded upon return of the card.
2.2 Payment
Payment is due immediately upon conclusion of the contract. Ticket purchases on credit or invoice are generally not permitted. Business customers, groups, and tour operators have the option of purchasing tickets in advance via the online shop. Any exceptions must be agreed in advance and are only valid if confirmed in writing by SEILBAHN STAUBERN AG. When paying on account, the customer undertakes to pay the invoiced amount within 30 days. Objections to the invoice must be made in writing and justified within 7 days. If the customer does not meet their payment obligation within the payment period, they shall be in default without further reminder upon expiry of this period and shall pay default interest of 5%. If payment is still not made after a further reminder, SEILBAHN STAUBERN AG reserves all rights, including the right to discontinue all services to the customer without further notice.
SEILBAHN STAUBERN AG reserves the right to demand full or partial advance payment for services. This is subject to any agreements to the contrary between the customer and SEILBAHN STAUBERN AG. Bank transfer and check fees are borne by the sender.
2.3 Currency
Prices are always quoted in Swiss francs (CHF). The euro conversion is made on a daily basis at the current exchange rate. Change is always paid out in Swiss francs.
2.4 Changes to prices and services
SEILBAHN STAUBERN AG expressly reserves the right to change service descriptions and prices on the Internet, in brochures, and in price lists until the contract is concluded.
3. Tickets and season tickets
3.1 Validity
All tickets and season tickets are personal and non-transferable. Annual tickets have a photo for verification purposes.
3.2 Age groups
Children under 6 travel free of charge. Reduced fares apply for children aged 6–14. Adult fares apply from the 15th birthday.
3.3 Loss or theft
In the event of loss or theft of a season ticket, a direct replacement will be provided upon presentation of the purchase receipt. After appropriate clarification, a replacement will only be provided if the ticket has not already been used. A processing fee of CHF 50 may be charged for issuing a replacement ticket.
3.4 Refunds
There is no refund entitlement for any products (annual tickets, single tickets, return tickets, and special tickets).
3.5 Misuse/forgery
Restaurant, train, or authorized inspection staff are authorized to check tickets at any time. Customers must identify themselves with an officially valid ID (ID card, passport, driver's license). Any misuse of tickets, in particular the transfer of tickets or alteration of the information contained therein, will result in immediate withdrawal without compensation. In addition to the fare for the unauthorized or invalid ticket, a surcharge of CHF 150.00 will be levied in accordance with Art. 16 of the Federal Transport Act of October 4, 1985. A valid ticket must also be purchased. SEILBAHN STAUBERN AG also reserves the right to report the matter to the police or to pursue criminal charges. The ticket holder is responsible for ensuring that their ticket is not misused by third parties.
4. Facilities
4.1 Disruptions to service provision/suspension of operations
Operational restrictions or suspensions due to force majeure such as wind and weather conditions, strikes or official orders, operational disruptions (e.g. foehn wind or technical defects such as power outages) do not entitle the ticket holder to a refund or compensation.
4.2 Reckless behaviour/misconduct on the part of the ticket purchaser
In the event of reckless behavior, violation of these provisions, or disregard of the instructions of railway, restaurant, or inspection personnel, SEILBAHN STAUBERN AG may withdraw the ticket holder's ticket. Anyone who damages or contaminates the facilities and equipment of SEILBAHN STAUBERN AG shall be required to pay the repair and cleaning costs. In the event of intentional damage/contamination, criminal charges may be filed.
4.3 Sports equipment
For safety reasons and in accordance with official regulations, sports equipment of any kind will not be transported. Exceptions may be made in individual cases; the operating staff of SEILBAHN STAUBERN AG will decide on the transport of all equipment and objects on the facilities of SEILBAHN STAUBERN AG.
5. Complaints
Any complaints by ticket purchasers concerning the services provided by SEILBAHN STAUBERN AG must be addressed to SEILBAHN STAUBERN AG immediately (within 1 hour). If immediate notification is not provided, the ticket purchaser forfeits any claims against SEILBAHN STAUBERN AG.
6. Internet / Websites
All information published on the Internet is provided without guarantee. SEILBAHN STAUBERN AG accepts no liability for Internet malfunctions, damage caused by third parties, imported data of any kind, in particular viruses, worms, Trojan horses, etc. The websites may contain technical inaccuracies or typographical errors. SEILBAHN STAUBERN AG is in no way liable for any direct, indirect, special, or other consequential damages resulting from the use of the SEILBAHN STAUBERN AG website or any website linked to it. Any liability for lost profits, business interruption, loss of programs, or other data in information systems is also excluded.
7. Liability
SEILBAHN STAUBERN AG's liability for personal injury and property damage is limited to those cases prescribed by Swiss law.
Liability for accidents outside the secured and marked hiking trails is completely excluded.
SEILBAHN STAUBERN AG is not liable for accidents resulting from:
• Failure to observe markings and information boards
• Leaving the marked hiking trails
• Failure to observe instructions and warnings from railway staff or restaurant staff
• Failure to observe other warnings
• Negligent or intentional behavior
• The condition of the hiking trail
8. Insurance
SEILBAHN STAUBERN AG recommends that all ticket purchasers take out supplementary insurance cover, such as liability insurance, cancellation insurance, travel accident and travel health insurance, extra return travel costs, insurance, etc.
9. Changes to the General Terms and Conditions (GTC) and other contractual provisions
SEILBAHN STAUBERN AG reserves the right to amend these GTC at any time. If the customer is significantly disadvantaged by the amendment to the GTC, they are entitled to terminate the contract upon the amended GTC coming into force. The right of termination expires when the amendment comes into force.
10. Final provisions
Communications by email are considered to be in writing. Swiss law applies exclusively to all contracts concluded with SEILBAHN STAUBERN AG under these GTC. The exclusive place of jurisdiction for any disputes arising from such contracts is 9467 Frümsen.
